PARTIES

This Service Contract Agreement (hereinafter referred to as the “Agreement”) is entered into on ________________ (the “Effective Date”), by and between King's Automotive Mobile Services, with an address of 1023 E. Princess St. York, PA 17403, (hereinafter referred to as the “Service Provider”) and , with an address of hereinafter referred to as the “Client”) (collectively referred to as the “Parties”).

LIST OF SERVICES PROVIDED AND THEIR PRICES

During the period of this Agreement, the Service Provider shall have the responsibility to perform and provide the following services (hereinafter referred to as “Services”):

The Services are to be paid for as follows:
cash, credit/debit, electronic transfer prior to delivery

INVOICES

The Parties agree that the invoiced amounts must be paid in full within prior to delivery. Failure to provide payment, upon delivery will result in your item not being released to you. All invoices not paid in cash are subject to processing fees. If making cash payment prior arrangements must be made and approved.

TERM OF AGREEMENT

This Agreement shall be effective on the date of signing this Agreement (hereinafter referred to as the “Effective Date”) and will end on items delivery.

TERMINATION

This Agreement may be terminated in the event that any of the following occurs:

Immediately in the event that one of the Parties breaches this Agreement.

With prior approval and agreement of parties in relation to uncontrollable events

This Agreement will automatically end upon the completion of the provision of the Services and payment.

RELATIONSHIP OF THE PARTIES

The Parties agree that this is a non-exclusive agreement and that the Parties are regarded as independent contractors.

AMENDMENTS

The Parties agree that any amendments made to this Agreement must be in writing, where they must be signed by both Parties to this Agreement.

Accordingly, any amendments made by the Parties will be applied to this Agreement.

ASSIGNMENT

The Parties are not entitled to assign the responsibilities that they have under this Agreement to anyone else, unless both Parties agree to the assignment and provide such agreement in writing.

ENTIRE AGREEMENT

This Agreement contains the entire agreement and understanding among the Parties to it with respect to its subject matter, and supersedes all prior agreements, understandings, inducements and conditions, express or implied, oral or written, of any nature whatsoever with respect to its subject matter. The express terms of the Agreement control and supersede any course of performance and/or usage of the trade inconsistent with any of its terms.

SEVERABILITY

In the event that any provision of this Agreement is found to be void and unenforceable by a court of competent jurisdiction, then the remaining provisions will remain in force in accordance with the Parties’ intention.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Pennsylvania

ALTERNATIVE DISPUTE RESOLUTION

Any dispute or difference whatsoever arising out of, or in connection with, this Agreement shall be submitted to arbitration/mediation/negotiation (circle one) in accordance with,subject

to the laws of Pennsylvania.

 

Additionally

Item(s) being transported over the road may encounter travel wear and tear such as: flat tire, loose/broken trim, wires and bolts, blown light bulbs, etc. may occur. In the event of such an event the client will be charged for unscheduled maintenance stops, parts and/or repairs. These additional fees are due immediately at time of service. King's Automotive Mobile Services, LLC. offers a bearings, tire and light service for $199.00 for one axle and $100 for each additional axle. This package must be purchased at time of booking. Also King's Automotive Mobile Services is not responsible for broken, stripped bolts, screws, lug nuts, frailed or rotten wires, hoses, harnesses, and any other failed mechanical components, needing repair, while item is being transported.

Any mileage, weight or service discrepancies, undisclosed at time of booking may result in additional charges, due at time of delivery.

In order to ensure timely deliveries/pickups drivers have preset wait times. Any wait time beyond 15 minutes, may result in wait fee.

White Glove Service, deliveries with flights of stairs, etc will be provided at an additional predetermined fee, prior to booking. Not disclosing this information at time of booking, may result in additional fees.

Changes in shipment dates by the client, may result in additional fees, depending on truck/trailer availability and schedules.

 

 

SIGNATURE AND DATE

The Parties hereby agree to the terms and conditions set forth in this Agreement and such is demonstrated by their signatures below and or client accepting estimate.

Client acknowledges that providing first/last name, billing address, email and shipping details , accepting estimate or conducting any business with King's Automotive Mobile Services, after receipt of this agreement, he/she is authorized to act as client or client's representative. , providing said details will be considered a formal agreement between provider and client. Once this information is provided, contract will be considered activated and enforcable, in lew of signature.
